Decree on the constitutional referendum, 5 January 2021 (Le Moniteur, Special No. 1)

The decree on the constitutional referendum, issued by President Jovenel Moïse and published in Le Moniteur, Special No. 1, of Tuesday 5 January 2021. It gives the CEP responsibility for planning, organizing and supervising the referendum and for publishing its results nationwide, on universal, direct, secret and free suffrage. The electorate is convened by presidential order setting the object, places and date of the vote and stating the question put. The referendum register is drawn from Office National d'Identification data; referendum lists are sent to voting centers and posted at least fifteen days before the vote, and ballots are delivered to the communes three days beforehand in numbers matching the registered electorate.

Campaigning for and against the draft Constitution is permitted, with public media required to give equal space to the OUI/WI and NON sides and private media to charge them equal advertising rates. The ballot is titled RÉPUBLIQUE D'HAÏTI / RÉFÉRENDUM CONSTITUTIONNEL 2021 and asks, in French and Kreyòl, whether the voter approves the draft Constitution, with a green OUI/WI box and a white NON box. The same issue carries a second decree granting the independent advisory committee more time to finish the draft. The referendum was postponed repeatedly and never held.
