Full Description

This decree, promulgated February 1, 2006 by transitional president Boniface Alexandre after deliberation in the Council of Ministers, fixes the organization and functioning of the commune, described as the territorial collectivity retained by the Constitution that must be endowed with a defined scope of autonomy. It expressly abrogates the decree-law of October 22, 1982 on communes. Across nine titles the decree addresses the commune's territorial delimitation, legal personality and administrative and financial autonomy, the composition, election, powers and functioning of the Conseil Municipal and the Assemblée Municipale, municipal resources and budget, personnel, urban planning and public-service responsibilities, and the tutelle (supervisory) relationship linking the commune to the section communale it groups and to the central administration. It is one of four companion decrees dated the same day implementing the framework decree on decentralization (also held in this batch); the others cover the section communale, the department, and the general framework itself.
