Decree Regulating Public Procurement of Services, Supplies and Works
- Fixes the rules for awarding, approving, executing and controlling public contracts for services, supplies and works.
- Its preamble states it exists to fill the vacuum left by a ministry, and hence the CNMP, that had ceased to function.
- Assigns the CNMP the setting of thresholds and procurement methods, and a code of ethics for officials and firms.
- Predates the Law of 12 June 2009 on the general rules for public procurement, which the corpus holds separately.
Article 1 states the decree's scope directly: it fixes the regulation of public procurement of services, supplies and works, and establishes the rules applicable to the award, approval, execution and control of public contracts. Its preamble is explicit that it exists to fill the vacuum left by a ministry, and consequently the Commission Nationale des Marchés Publics, that had ceased to function. It assigns the CNMP tasks including setting applicable thresholds and procurement methods and drawing up a code of ethics for officials and private firms involved in procurement. This is the regime that preceded the Law of 12 June 2009 on the general rules for public procurement, which the corpus already holds, so the two together document the change in Haiti's procurement framework.
