Referendum Decree of 2025 (Le Moniteur, Special No. 45, 3 July 2025)

The 2025 referendum decree, issued by the Transitional Presidential Council and published in Le Moniteur, Special No. 45, of Thursday 3 July 2025, signed by all nine council members. It sets the general rules for the constitutional referendum: the CEP plans, organizes and supervises the vote and publishes the results nationwide, on universal, direct, secret and free suffrage, with the electorate convened by presidential order fixing the object, places and date and stating the question. Its main departure from the January 2021 decree is on-the-spot registration: voters may register at the voting bureau of their choice under procedures the CEP defines, with each bureau keeping a separate list of on-site registrations for control purposes and entries recorded on a signature list once validated.

On polling day a voter presents a national identification card, a passport or another accepted document. Voting bureaux have three members and the list of members is available at least fifteen days before the vote; the CEP may open more than two voting centers in a communal section where numbers or distance justify it. The ballot asks, in French and Kreyòl, whether the voter approves the draft Constitution, with a green OUI-WI box and a white NON box. The same Moniteur issue carries an unrelated DGI notice on state-land occupants' obligation to pay farm rents. Critics of the referendum invoke article 284-3 of the 1987 Constitution, which bars any referendum aimed at amending it.
