Bulletin des arrêts du Tribunal de cassation, 1911-1913

Summary: Rulings of the Haitian Tribunal de cassation for 1911 to 1913, in civil, criminal and urgent matters. Rulings whose dated audiences span 1911 to 1913, concentrated on 1913; commerce and surveying again lead the substantive profile.

Full Description

The Bulletin des arrêts is the published record of the Tribunal de cassation, Haiti's court of final appeal. Each volume prints the rulings in full, each headed by the point of law decided, which makes the series usable: a reader can see how the court read a code article before reading the reasoning.

The dated audiences run 1911 to 1913, concentrated on 1913, so this volume and the one before it overlap: together they cover the litigation of 1907 to 1913 without a clean annual boundary.

That overlap is characteristic of the series in this decade, and it is why the corpus holds the volumes together: no single one is the record of a given year. The corpus holds the Annuaire de législation volumes for the same years, so the legislation and the case law of 1907 to 1913 can now be read side by side from one place.

Contract enforcement, the execution of judgments and the settlement of property claims are the constraints every business-climate diagnostic of Haiti names, and this series is the primary record of how the highest court actually decided them.
