The notice is short and it is the whole of the Court's public position on prior contract control for the fiscal year. It cites article 200-4 of the amended 1987 constitution and article 5, paragraph 3 of the decree of 23 November 2005 establishing the Court's organisation and functioning, and on that basis restates that every draft contract to which the State is a party must come to the Court for a reasoned prior opinion.

Three operative statements follow. The Court does not intervene on contracts already executed or under execution. Any commitment entered into outside the legal prescriptions cannot be taken into account by the Court. And 18 September 2026 is the deadline for submitting draft contracts intended to take effect during fiscal year 2025-2026.

MAIS CNET ETS Port-au-Prince, le ) 3 SEPl 10 AVIS AUX INSTITUTIONS PUBLIQUES En référence aux dispositions de l’article 200-4 de la Constitution de 1987 amendée et de l’article 5, alinéa 3 du Décret du 23 novembre 2005 établissant son organisation et son fonctionnement, la Cour Supérieure des Comptes et du Contentieux Administratif (CSCCA) rappelle que tous les projets de contrat auxquels l'Etat est partie doivent lui être soumis pour avis motivé préalable. La Cour souligne qu’elle n'intervient pas sur les contrats déjà exécutés ou en cours d'exécution. En conséquence, tout engagement pris en dehors des prescriptions légales ne pourra être pris en compte par la CSCCA. Elle saisit cette occasion pour informer les Institutions publiques que le 18 septembre 2026 constitue la date limite pour lui soumettre les projets de contrat devant prendre effet au cours de l'exercice fiscal 2025 - 2026.
