sur le projet de contrat signé entre le Ministère de la Planification et de la Coopération
Externe et HELICO S.A
La Cour Supérieure des Comptes et du Contentieux Administratif (CSCCA) accuse réception le 29
avril 2020 de votre correspondance datée du 28 avril 2020 et référencée (MPCE/UAJ/CSCCA/ 1667),
par laquelle vous lui avez soumis le projet de contrat signé entre le Ministère de la Planification et de
la Coopération Externe (MPCE) et HELICO S.A, pour l'affrètement de trois (3) hélicoptères à bord
desquels cette société va s'engager à assurer le transport des hauts Dignitaires de l'Etat haïtien, des
Cadres de l'Administration publique nationale ainsi que des Dignitaires étrangers en visite en Haïti,
pour un montant de TROIS MILLIONS TROIS-CENT-QUARANTE-CINQ MILLE QUATRE-
VINGT-QUATORZE ET 46/100 Dollars Américains (3.345,094.46 USD) payable en gourdes au
taux référentiel de la Banque de la République d'Haïti, pour une durée de douze mois allant du 1®
octobre 2019 au 30 septembre 2020.
Après analyse du projet de contrat, la Cour note que :
1- A l’article 6, puisqu'il existe des pénalités de retard, il faudra prévoir des intérêts moratoires
dans un article ;
2- A l’article 19, le contrat ne peut prendre effet avant l'avis motivé de la Cour. De plus, le
contrat doit être fait en quatre exemplaires original et pas en double ;
3- Les annexes du projet de contrat ne sont pas visées par les deux parties ; à |
4- Se référant au point d, du rapport d'analyse de la Commission Nationale des Marchés Publics (CNMP)
en date du 24 avril 2020 ainsi libellé : « Le Trésor public gagnerair si l'Etat haïtien consentail à faire
