Public Leaflet: What You Should Know About Asset Declaration

This is a two-page public information leaflet in Kreyòl (Haitian Creole), published by the ULCC in November 2023 ('Première édition, Novembre 2023') to mark its first Journée de déclaration de patrimoine held 28 February 2023. Structured as nine short questions and answers with citations to the specific articles of the 12 February 2008 asset-declaration law, it covers: what an asset declaration is and why the law requires it (to fight corruption and prevent sudden unexplained enrichment by public officials); which categories of people must file (the President, Prime Minister, ministers, secretaries of state, director generals and their deputies, cabinet members, senior diplomats, senators and deputies, judges and prosecutors, CSCCA members, the Protecteur du Citoyen, CEP members, university rectors and deans, mayors and CASEC/ASEC members, public accountants, board members of state enterprises such as the BRH, BPH and BNC, police and army personnel, and DGI, AGD, UCREF and ULCC investigators); the 30-day filing deadlines on entering and leaving a post; how to file (a special ULCC form, notarized and deposited with the court registry); what must be declared (property, land, vehicles, businesses, valuable jewelry, bank accounts, and debts); the confidentiality obligations on ULCC agents and court clerks handling declarations, with a one-to-three-year prison sentence and a 250,000-500,000-gourde fine for unauthorized disclosure; the sanctions for non-filing, including a quarter-salary withholding until compliance and, after leaving office without filing, loss of voting, eligibility, jury, witness, weapons-carrying and other civil rights; and the role of the ULCC's asset-verification and monitoring brigade in investigating declarations and referring false ones for prosecution.
