Draft law enacting a new Penal Code
- 345 pages, seven books, ending in transitional and final provisions.
- Signed by Jovenel Moïse and routed to Parliament, not issued as a decree.
- The same reform was later put in force by the décret of 2020, which the corpus holds, so the two can be compared.
- The preamble rests on ratified conventions of 1926, 1950, 1952 and 1955.
The draft law enacting a new Penal Code, 345 pages, signed by Jovenel Moïse.
The preamble is built on ratified international instruments: the 1926 Slavery Convention sanctioned by the National Assembly decree of 13 May 1927, the Genocide Convention sanctioned on 23 August 1950, the 1952 convention on the suppression of trafficking in persons, and the Geneva Conventions ratified on 14 July 1955. The table of contents runs to seven books, ending with transitional and final provisions.
The corpus already holds the Penal Code that preceded the reform, the consolidated edition, and the décret of 2020 that put a new code in force outside Parliament. This file is the version that went through the Council of Ministers and was destined for a parliamentary vote, which is the version against which the decree's departures can be read. Criminal law is economic infrastructure here: the code carries the offences that govern contract fraud, corruption, smuggling and the treatment of commercial disputes.
