- Central administration institutions may act as contracting authority for projects in the Triennial Investment Plans and the finance laws, against Public Investment Programme credits.
- They may delegate that role to another sector under a protocol of agreement.
- An institution must inform the benefiting sector before sending a draft contract to the CSCCA.
- The same issue promulgates the law amending the 2009 kidnapping law, voted 21 February and 22 August 2017.
Le Moniteur, No. 156, Wednesday 4 October 2017.
Article 1 of the arrêté empowers the institutions of the central administration to design and implement all development plans, programmes and projects, and all programmes and projects entered in the Plans Triennaux d'Investissement and in the finance laws, against the credits carried in the Public Investment Programme, in line with the rules governing public procurement and service concession agreements. Article 2 lets those institutions delegate the contracting authority function to other sectors under a protocol of agreement. Article 3 requires an institution holding the credit, and acting as maître d'ouvrage, to inform the benefiting sector before sending the draft contract to the Cour Supérieure des Comptes et du Contentieux Administratif.
The preamble cites the Treaty of Chaguaramas creating CARICOM, ratified by the decree of 13 May 2002, and the 2005 decrees on the central administration and the public service statute.
The issue also carries the presidential order promulgating the law amending the law of 20 January 2009 on abduction, kidnapping, unlawful detention and hostage-taking, voted in the Senate on 21 February 2017 and in the Chamber of Deputies on 22 August 2017, given on 22 September 2017. The corpus holds that law separately. This issue adds the arrêté on contracting authority.
