Arrêté approving the procedures manual for public procurement, CNMP and CCOSP (Le Moniteur, 164th year Special No. 11, 4 November 2009)
The procedures manual for public procurement and for public service works concession agreements, given legal force by an arrêté of 26 October 2009 and published in Le Moniteur on 4 November 2009. It puts the procurement law of 10 June 2009 into operation, and takes effect when the decree of 3 December 2004 ceases to apply under article 97 of that law. Four chapters set out the procedures. Chapter I covers the general procedures: open tender, open tender preceded by pre-qualification, and two-stage tendering. Chapter II covers the exceptional procedures, which are restricted tender without pre-qualification and direct agreement. Chapter III covers the specific procedures for intellectual services contracts and for standing-order and client contracts. Chapter IV applies the general and exceptional procedures to public service works concessions and sets the award criteria, among them performance standards, continuity of service, the tariffs charged to users, socio-economic development potential, environmental compliance and the residual value of the installations. Each procedure is written as the tasks falling to the contracting authority, which makes the manual the operating reference for the CNMP and the CCOSP.
