Status Report on the Parliamentary Seminar on the Draft Decentralization Framework Law
Summary: A status report from the August 2012 parliamentary seminar (organized by the Bloc Parlementaire) that brought together civil society, elected officials, civil servants and CASEC/ASEC representatives to clarify the division of competences between central and local government ahead of a draft decentralization framework law.
Key Findings
- Reports a status point taken mid-seminar, on 18 August 2012, during the 16 to 20 August seminar on the draft framework law on decentralization and local governance convened on the initiative of the parliamentary bloc and the commission.
- Records who was in the room, which is what makes the record useful: civil society members, elected officials, state civil servants, CASEC and ASEC representatives, delegates and vice-delegates, academics and representatives of the international community, across three days of workshops.
- States the working method: confronting what the discussions produce with the 2009 draft framework law in order to enrich that text and arrive, with the bloc's and commission's recommendations, at a new proposal capable of being voted by the Chamber of Deputies and the Senate.
- Names the problem as a lack of clarity in the distribution of competences between the state through its central and deconcentrated organs and the territorial collectivities through departments, communes and communal sections.
- Lists the competences at issue: land-use planning, urbanism and land tenure, environment, literacy, vocational training, education, civil registry, security, health, water, electricity, cemeteries and markets.
- Rejects assigning a whole policy to a single actor, since each policy comprises multiple activities, which is the analytical move the seminar was organized around.
