Compendium of Annotated Normative Texts Governing Local Action
- Gathers in one annotated volume the normative texts bearing on Haitian local government, which are otherwise scattered across decrees, laws and orders of different eras.
- The annotations run throughout, so the compendium records how the ministry itself reads each provision rather than only reproducing it.
- Carries the financial provisions that govern communal revenue, including the split of concession proceeds at 85 percent to the territorial collectivities management and development fund and 15 percent to a social security protection fund.
- Sets out the thresholds that determine communal control of a company, turning on whether the commune holds more than 50 percent of the shares.
- Includes the tax provisions applying to local taxpayers, among them the exemption for annual incomes not exceeding 120,000 gourdes.
- Produced with the USAID/LOKAL project, so it is a ministry publication with donor support rather than an external commentary.
Published by the Ministry of the Interior and Territorial Collectivities with the USAID/LOKAL project, first edition April 2011, this is a thematic compendium of the normative texts bearing on local government in Haiti, annotated throughout. Its introduction places the work in the post-Duvalier decentralization debate and the 1987 constitution's commitment to effective decentralization, and notes that relevant instruments range from nineteenth-century texts to the January 2009 law on the drinking water and sanitation sector, and that much of the live argument concerns the February 2006 decrees. The body is organized by field of local competence: economic action, the commune's domain, collective public facilities and services, enforcement, expropriation and public utility, local finances and taxation, public institutions and administration, administrative policing and public security, natural resources and environment, and urban planning and territorial development. It closes with a list of the laws, decrees and orders reproduced and an alphabetical index, which makes it usable as a finding aid for Haitian local-government law as it stood in 2011.
