Decree on the Modalities of Organization and Functioning of the Departmental Collectivity
- Promulgated 1 February 2006, the highest of three tiers of territorial collectivity (department, above commune and section communale).
- Governs the Conseil Départemental and Assemblée Départementale.
- Assigns the department a coordinating role over the development plans of the communes it groups.
- One of a coherent four-decree decentralization package dated the same day.
This decree, promulgated 1 February 2006 by transitional president Boniface Alexandre after deliberation in the Council of Ministers, fixes the modalities of organization and functioning of the departmental collectivity, the highest of the three tiers of territorial collectivity in Haiti's decentralization architecture, above the commune and the communal section. Across its titles the decree covers the department's legal personality and administrative and financial autonomy, the composition, election, powers and functioning of the Conseil Départemental and the Assemblée Départementale, the department's role in coordinating and harmonizing the development plans of the communes it groups, its own resources and budget, and the tutelle (supervisory) relationship with central government. It is one of four companion decrees dated the same day implementing the framework decree on decentralization (also held in this batch); the others cover the section communale, the commune, and the general framework itself.
