Full Description

The Bulletin des arrêts is the published record of the Tribunal de cassation, Haiti's court of final appeal. Each volume prints the rulings in full, each headed by the point of law decided, which makes the series usable: a reader can see how the court read a code article before reading the reasoning.

The title page states the exercice 1948-1949 and the volume is printed at the Imprimerie de l'État on rue Hammerton Killick in Port-au-Prince.

Contract, bail and sale lead the substantive profile, with bail, the lease, unusually prominent. Lease litigation reaches the final court in numbers when urban property is scarce and rents are contested, and 1949 is the year of the Port-au-Prince bicentenary exposition, which reshaped the waterfront and the rental market around it.

This is the last volume of the series the Internet Archive holds. Anything the Tribunal de cassation published after 1949 is not in this batch and remains to be located.

Contract enforcement, the execution of judgments and the settlement of property claims are the constraints every business-climate diagnostic of Haiti names, and this series is the primary record of how the highest court actually decided them.
