Full Description

The Bulletin des arrêts is the published record of the Tribunal de cassation, Haiti's court of final appeal. Each volume prints the rulings in full, each headed by the point of law decided, which makes the series usable: a reader can see how the court read a code article before reading the reasoning.

The title page states the exercices 1942-1943 and 1943-1944, and the dated audiences bear it out, running 1941 to 1944 with 1943 and 1942 dominant.

Contract, sale and seizure lead. Taken with the preceding volume this is a continuous record of commercial adjudication through the war years, when Haiti's export trade and its import supply were both disrupted and the resulting disputes over delivery, price and payment reached the final court.

Contract enforcement, the execution of judgments and the settlement of property claims are the constraints every business-climate diagnostic of Haiti names, and this series is the primary record of how the highest court actually decided them.
