CSCCA Opinion on the draft concession contract between the Ministry of Public Works, Transport and Communications with Électricité d'Haïti and the consortium of General Electric International, Inc. and GE Global Parts & Products GmbH (14 August 2020)
- The 14 August 2020 CSCCA opinion reviewed a concession contract between MTPTC/EDH and a General Electric group for detailed engineering, supply and construction of a dual-fuel power plant in Carrefour.
- CSCCA received the submission on 6 August 2020 from correspondence dated and numbered the same day.
- The project concerned a 55.5 MW diesel and LPG or natural-gas plant at a cost of 57.488 million US dollars and an execution period of 50.5 weeks.
- The Court identified general inconsistencies, including a quotation request addressed to a different GE name, missing Council of Ministers authorization, divergent descriptions of the plant scope and lack of contract date.
- It also found missing or untranslated annexes, an unnotarized consortium agreement, missing registration or legalization, and missing financial, experience, personnel, equipment, tax and MEF documents.
- The Court returned the proposed contract to MTPTC/EDH for necessary follow-up.
The reasoned opinion the court issued, under article 5 of the decree of 23 November 2005, on the draft concession contract between the Ministry of Public Works, Transport and Communications with Électricité d'Haïti and the consortium of General Electric International, Inc. and GE Global Parts & Products GmbH. The transmitting letter was received in août 2020. The opinion sets out the documents received, the points of law and form the court raises, and its conclusion. The court's opinions on named contracts are seldom published, and these date from the period when the Ministry of Planning was awarding contracts under emergency procedures.
