sur le projet de protocole d'accord signé entre le Ministère de la Planification et de la
Coopération Externe (MPCE) et le Ministère des Travaux Publics, Transports et
Communications (MTPTC)
# Cour Supérieure des Comptes et du Contentieux Administratif (CSCCA) accuse réception le 29
wvril 2020, de votre correspondance datée du 28 avril 2020 et référencée (MPCE/UAJ/CSCCA-
1657), par lnquelle vous lui avez soumis le projet de protocole d'accord signé entre le Ministère de
la Planification et de la Coopération Externe (MPCE) et le Ministère des Travaux Publics,
Transports et Communications (MTPTC) en vue de la réalisation des travaux de réhabilitation des
systèmes d'éclairage de lampadaires solaires, installés dans certains quartiers de Port-au-Prince et
dans d'autres communes avoisinantes.
Après analyse du projet de protocole, la Cour note que :
1- L'article 1 du projet de protocole d'accord est à revoir. L'objet consiste à déléguer la
maitrise d'ouvrage du projet relatif àla réhabilitation des systèmes d'éclairage de ”
lampadaires solaires ;
2- La Cour suggère d'insérer les informations suivantes dans les engagements du MTPTC :
#) Définir les conditions administratives, financières et techniques selon lesquelles les
travaux seront réalisés ; c
b) Préparer les dossiers d'appel d'offres pour la sélection des entreprises et ln signature de
marché ;
C) Faire le suivi technique des travaux et le contrôle de La qualité ;
d) D'engager à conserver pour les besoins d'audits, toutes pièces justificatives de dépenses,
paiements ou transferts de fonds effectués dans le cadre du projet :
3- A l'article 7, premier paragraphe, il faudra préciser que «le MTPTC à engager les
procédures nationales de passation de marchés y relative ;
4- A l'article 8, la durée du protocole n'est pas précise ;
5- A l'article 10, le titre fait mention des instruments, la Cour demande s'il s'agit du
protocole ou d'autres instruments à valider dans le cadre de ce protocole ;
6- Le protocole d'accord n'est pas signé ni visé par les deux parties ;
7- Les documents suivants ne sont pas joints au dossier :
a) Le contrat d'achat des lampadaires initialement installés ;
b) Le rapport de l'état des lieux des travaux à effectuer.
En conséquence, la Cour retourne ledit protocole d'accord au MPCE.
