The preamble cites article 136 of the Constitution, the decree of 17 May 2005 organising the central administration, the law of 10 June 2009 fixing the general rules on public procurement and public service concession agreements, the arrêté of 26 October 2009 setting the modalities for applying that law, and the arrêté of 26 October 2009 bringing into force the procedure manual for awarding public contracts and concession agreements.

Standard documents are the operative layer of a procurement regime. The law fixes who may contract and above what threshold; the standard documents fix how a bid is scored and how execution is monitored, which is where a discretionary award is either constrained or not.
