Arrêté bringing into force the Code of Ethics for actors in public procurement and service concession agreements, Le Moniteur No. 3 of 9 January 2013
- The charter binds all actors in public procurement and service concession agreements, and is annexed to the arrêté of 21 December 2012.
- Article 1 requires the contracting authority to publish accessible information in time and to leave bidders enough time to prepare an offer.
- The same issue declares of public utility a plot on Avenue Maïs Gâté in Delmas and carries two Council of Ministers resolutions.
- The charter is the conduct layer of the 2009 procurement regime the corpus already documents.
Le Moniteur, 168e année, No. 3, Wednesday 9 January 2013, a numéro extraordinaire.
The second item is the arrêté of 21 December 2012 bringing into full effect the Charte d'Éthique applicable to actors in public procurement and in service concession agreements, with the text of the charter annexed. Article 1 of the charter requires the contracting authority to make information readily accessible and available in time to any natural or legal person, and to leave candidates enough time to prepare and submit offers before the deposit deadline.
The issue also carries an arrêté declaring of public utility a plot on Avenue Maïs Gâté in the St-Martin communal section of Delmas, bounded to the north by the Centre Ambulancier National, with the usual freeze on construction, road cutting, subdivision and property transactions, and two Council of Ministers resolutions of 21 December 2012.
The corpus holds the procurement law of 10 June 2009, its application arrêtés, the standard bidding documents and the procedure manuals. An ethics charter with a publication and timeliness duty at its head is the conduct layer of that regime, and it is the instrument a complaint about a rushed tender would cite.
