Decree of 26 June 1987 giving CONATEL technical means and setting a taxation regime for frequency use (Le Moniteur, 142nd year No. 76, 17 September 1987)
- Article 1 groups radiocommunication stations in four categories, A to D, with broadcasting inside category A.
- Article 2 sets broadcasting classes by nominal power and service area, from class A above 10 kilowatts to class D below 500 watts, plus a community class.
- Article 3 carries a schedule of annual fees in gourdes per frequency, set against the emission designation.
- The stated reason is that the previous regime did not match rational spectrum use or current emission designations.
The decree of 26 June 1987, published in Le Moniteur, 142nd year No. 76, of Thursday 17 September 1987, is the fee instrument of the Haitian spectrum regime. It was taken by the Conseil National de Gouvernement under Articles 285 and 285-1 of the 1987 Constitution, on the report of the public works and finance ministers, its stated reason being that the taxation system then in force did not answer the requirements of rational use of the radio spectrum or the new methods of describing and designating emissions.
Article 1 groups radiocommunication stations in four categories: A for stations serving private or public correspondence, which is where broadcasting stations sit, other than aeronautical, maritime, amateur and general radio services; B for aeronautical and maritime service stations; C for amateur radio; D for general radio.
Article 2 defines classes within sound broadcasting by frequency band, nominal radiated power and service area. For hectometric-wave broadcasting, class A runs above 10 kilowatts by day, class B between 5 and 10, class BC between 1 and 5 by day, class C1 between 500 watts and 1 kilowatt, and class D below 500 watts. A separate community class covers a station serving a neighbourhood, a town or a locality with its contiguous suburban zones.
Article 3 carries the schedule itself: a fee in gourdes per frequency per year, set against the emission designation, running through amplitude modulation telegraphy, telephony, facsimile, television and the remaining emission classes.
This decree is cited by every later CONATEL decision in this corpus that levies or refers to spectrum charges, and it is the missing term between the 1969 decree that created the regulator and the 1987 decree of 10 June that redefined its mission.
