Law Setting the Minimum Wage Payable in Industrial and Commercial Establishments

Legislative Body of Haiti • 2009-10 • 5 pages
Summary: Law No. CL-09-2009-010 setting the minimum wage payable in industrial and commercial establishments, published in Le Moniteur No. 109 of 6 October 2009. It is the statute behind the minimum-wage debate that has shaped Haiti's apparel sector since.
Full Description

This is the 2009 minimum-wage law, the instrument at the center of one of the most closely watched labor disputes in recent Haitian economic history. The setting of a statutory floor for pay in industrial and commercial establishments bears directly on the export assembly sector, where wage levels are both the principal cost variable for employers and the principal grievance in recurring industrial action; the corpus's Better Work Haiti reporting tracks compliance with this statute factory by factory. The law is numbered CL-09-2009-010 in the Corps Législatif series. The gazette issue that carries it also contains a declaration on the amendment of the 1987 Constitution, following an executive proposal of 4 September 2009 asking the legislature to declare that there were grounds to amend - a reminder that the same session was handling both matters. Published in Le Moniteur, 164th year, No. 109, Tuesday 6 October 2009, as an extraordinary issue.
