OE-CNT-DEC20130005: CONATEL decision of 2 August 2013 requiring telephone and internet operators to report monthly traffic and statistical data (Le Moniteur, 168th year No. 150, 16 August 2013)

Le Moniteur, 168th year No. 150, of Friday 16 August 2013, a numéro extraordinaire, carries CONATEL decision OE-CNT-DEC20130005 of 2 August 2013, alongside two appointment orders for the national broadcaster and the prime minister's cabinet and two pension notices.

The decision is the reporting mandate behind the sector statistics CONATEL publishes. Article 1 requires every state concessionaire providing telephony, fixed, mobile or VOIP, or internet access, to send CONATEL by the 15th of each month the series listed for its activity.

Mobile operators report outgoing and incoming international traffic in minutes and in call counts, on-net and off-net local traffic in minutes and in call counts, international incoming and outgoing SMS totals, on-net and off-net local SMS totals, active prepaid and postpaid SIM cards by network, and the features and tariffs of each plan. Fixed operators report lines, subscribers split between households and businesses, the same international and local traffic series, and plan features and tariffs. Internet providers report the subscriber base split between households and businesses, the number of plans with descriptions and tariffs, and subscribers by plan type. VOIP providers report total subscribers, off-net traffic and calls in both directions, on-net traffic and calls between the operator's subscribers, and plan features and tariffs. Every category reports revenue by service category, total current employment where possible, and new jobs.

Article 2 fines a month's non-transmission 50,000 gourdes for each day of default, running from the day after the deadline until CONATEL's agents acknowledge receipt. Article 3 puts the decision in force on publication.

The decision rests on the decree of 27 September 1969 creating CONATEL, the decree of 12 October 1977 granting the state the telecommunications monopoly, the law of 22 August 1983 on the recovery of state debts, and the decree of 10 June 1987 redefining CONATEL's mission, all of which the corpus holds.
