Order Setting the Public Procurement Thresholds and the CNMP's Prior-Control Thresholds (23 February 2026)
- The order revises, effective 23 February 2026, the thresholds above which Haitian public bodies must run formal procurement procedures and the thresholds above which the CNMP exercises prior control.
- It sets a base threshold of 15,000,000 gourdes for central-state bodies and public enterprises, with CNMP prior-control bands of 75,000,000 (works), 25,000,000 (goods) and 20,000,000 (services) gourdes.
- It sets a base threshold of 5,500,000 gourdes for department-capital communes and select metropolitan communes (Delmas, Pétion-Ville, Carrefour, Tabarre, Cité Soleil, Croix-des-Bouquets), with its own CNMP prior-control bands.
- It is a purely regulatory schedule with no narrative findings; specific bands by tier, commune and procedure should be read directly from the text.
This order (arrêté), issued by Haiti's Council of Ministers on 23 February 2026 under the transitional government and published as a special issue of the official gazette Le Moniteur (No. 14) on 24 March 2026, revises the monetary thresholds set under the Law of 10 June 2009 on Public Procurement and Public-Service Concession Agreements. Its stated purpose (Article 1) is to update the thresholds that trigger formal procurement procedures and the thresholds above which the Commission Nationale des Marchés Publics (CNMP) exercises prior control (contrôle a priori).
The order distinguishes 'commande hors marché' (purchases on simple invoice, below any procurement-procedure threshold), 'marchés hors contrôle a priori de la CNMP' (procurement procedures not requiring CNMP sign-off), and 'marchés sous contrôle a priori de la CNMP.' It sets three tiers of contracting authority: central-state bodies, public enterprises and majority-public mixed enterprises (Article 3: 15,000,000 gourdes base threshold; Article 3.1: CNMP prior-control thresholds of 75,000,000 gourdes for works, 25,000,000 for goods, and 20,000,000 for services and intellectual-service contracts); department-capital communes plus Delmas, Pétion-Ville, Carrefour, Tabarre, Cité Soleil and Croix-des-Bouquets (Article 4: 5,500,000 gourdes base threshold); and other communes and communal sections, each with their own procedure-specific bands (demande de cotations, demande de prix, demande de propositions, and 'procédures allégées').
It is a purely regulatory, threshold-setting instrument: it contains no findings, budget figures or narrative content beyond the schedule itself, and the full set of bands by tier and procedure should be read directly from the order for any application. It was signed at the Palais National by Prime Minister Alix Didier Fils-Aimé, the Minister of Economy and Finance, and the full cabinet.
