The decree of 27 September 1969, published in Le Moniteur, 124th year No. 105, of Thursday 30 October 1969, creates the Conseil National des Télécommunications.
Its stated occasion is contractual. The preamble recites the decree of 8 August 1968 sanctioning a contract between the Haitian state and the Compagnie de Téléphone Continental for the overhaul and operation of the national telecommunications system, and reasons that the contract signed on 6 August 1968 requires a special control body able to take over the activities of the telecommunications service other than maintenance and operation of the network. The decree is taken under the decree of 21 September 1969, which suspended constitutional guarantees and granted the executive full powers until the second Monday of April 1970.
Article 1 creates the body. Article 2 attaches it to the Secrétairerie d'État des Travaux Publics, Transports et Communications and sets its membership at a technical director, an administrative director and a coordinator. Article 3 requires the technical director to have at least ten years of telecommunications experience and makes him answerable to the secretary of state. Article 6 adds technical advisers for telephony, radiocommunications, and broadcasting and television. Article 7 lists the council's activities: frequency allocation following the IFRB allocation table, technical authorization and inspection of radiocommunication stations, arbitration of disputes between companies, private or state bodies and third parties, preservation of third-party rights under state contracts, liaison with the state bodies running aeronautical, meteorological and maritime telecommunications, and reporting to government on the development, suspension, lapse or termination of telecommunications concessions and on draft treaties and international agreements.
Every later CONATEL instrument in this corpus opens by citing this decree. It is the first of the three founding texts, with the decree of 12 October 1977 granting the state the telecommunications monopoly and the decree of 10 June 1987 redefining CONATEL's mission, both of which the corpus also holds.
