Law Sanctioning Money Laundering and the Financing of Terrorism

Legislative Body of Haiti • 2013-11 • 28 pages
Summary: Haiti's anti-money-laundering and counter-terrorist-financing law, published in Le Moniteur No. 212 of 14 November 2013. It was voted at an extraordinary session of Parliament convened by the President because the ordinary session had ended and certain laws were urgent.
Full Description

This is the principal Haitian statute on money laundering and terrorist financing, superseding the narrower 2001 law that had covered laundering of assets from drug trafficking and other serious offences. The gazette issue that carries it opens with the President's message convening Parliament to an extraordinary session: the second ordinary session had ended on the second Monday of September 2013, and the vote on certain laws was urgent - the mechanism by which this law reached the statute book. The reform was driven by Haiti's standing in the international anti-money-laundering assessment process, and the law is the reference for the obligations of reporting entities, the suspicious-transaction reporting regime, asset freezing and confiscation, and the offences themselves. It should be read together with the 2017 law on the organization of the financial intelligence unit, which sets up the body that receives the reports this law requires.
