Law on the Laundering of Assets from Illicit Drug Trafficking and Other Serious Offences

Legislative Body of Haiti • 2001-04 • 16 pages
Summary: Haiti's first substantial anti-money-laundering statute, published in Le Moniteur No. 30 of 5 April 2001. It covers the laundering of assets derived from illicit drug trafficking and other serious offences, and was superseded in 2013 by the broader money-laundering and terrorist-financing law.
Full Description

This law established the Haitian offence of laundering assets derived from illicit drug trafficking and other serious offences, and the reporting and confiscation machinery around it. Its preamble cites articles 19, 32, 136, 144 and 241 of the Constitution, the Penal Code, the Code of Criminal Instruction, and the law of 17 August 1979 creating the central bank. It is the origin of Haiti's reporting-entity regime and of the financial intelligence function later reorganised as UCREF. It was superseded in substance by the law of 2013 sanctioning money laundering and the financing of terrorism, but remains the reference for understanding what the Haitian framework looked like in the decade before that reform, and for reading cases and evaluations from that period. Published in Le Moniteur, 156th year, No. 30, Thursday 5 April 2001.
