Electoral Decree of 5 July 2021 (Le Moniteur, Special No. 36)

The electoral decree signed by President Jovenel Moïse on July 3, 2021 and published in Le Moniteur, Special No. 36, of Monday July 5, 2021, four days before his assassination. Running to 384 articles, it sets the rules for presidential, legislative, territorial-collectivity and indirect elections: the mission and organs of the Conseil Électoral Provisoire, the electoral register drawn from ONI data, candidacy conditions, campaign financing, polling and tabulation, the electoral disputes machinery and the criminal offences attached to the process. It fixes a quota of at least thirty percent women and two percent people with disabilities in the competitive recruitment of departmental and communal electoral bureau members, keeps the Senate at three senators per geographical department on six-year terms, and sets candidate registration fees of 800,000 gourdes for the presidency, 120,000 for the Senate and 60,000 for the Chamber of Deputies, payable to the DGI on the Council's account. The later transitional decrees of December 2025 and June 2026 should be read in relation to it.
