Attempted release at the Port-au-Prince prosecutor's office: the RNDDH demands an inquiry into a magistrate's conduct
- A deputy government commissioner tried to release two men charged with murder on 11 November 2022.
- Their case was pending before an investigating magistrate, which put it beyond the prosecutor's reach.
- The network opened its inquiry as soon as the victim's relatives told it what had happened.
- It asks for an immediate inquiry into the magistrate's conduct and for the certification of the whole prosecutor's office staff.
The network was told by relatives of the victim that a deputy government commissioner at the Port-au-Prince court of first instance had tried on 11 November 2022 to release two named men charged with murder, at a point when their case was pending before an investigating magistrate's chambers and therefore out of the prosecutor's hands. It opened an inquiry immediately and publishes what it gathered. The document is short and its two recommendations are narrow: that an inquiry be opened at once into the deputy commissioner's conduct in this attempted release, and that all the judicial staff attached to the prosecutor's office at the Port-au-Prince court of first instance be certified.
