The assassination of President Jovenel Moïse: every party's right to judicial guarantees systematically violated

Summary: One year on, the network turns from who killed the President to how the case is being run, and finds the right to judicial guarantees violated for everyone in it, including the detainees, some of whom have died in custody.
Key Findings
Full Description

The report sets the country's socio-political context since the assassination, then follows the case through each institution that has touched it. On the police side it covers the arrests and imprisonments in Haiti and abroad, the continuation of the inquiry by the judicial police directorate, and the inspectorate general's own investigation. On the judicial side it examines the conduct of the investigating magistrate and the deaths recorded during the proceedings.

It then takes the detainees one by one, separating those the investigating magistrate has heard from those he has not, and describing the conditions in which they are held. The finding that gives the report its title is that the right to judicial guarantees has been systematically violated for every party, which for the network is a distinct wrong from the assassination itself and one that will make any eventual verdict harder to stand behind. Its recommendations are that people held in connection with the case be treated in strict accordance with the Standard Minimum Rules for the Treatment of Prisoners, and that everyone involved in preparing and committing the assassination be tried and convicted.
