Law Creating the National Education Fund (FNE)
The National Education Fund is the vehicle through which Haiti earmarked revenue for schooling, and this law is its statutory basis. The preamble grounds it in the education articles of the amended Constitution of 29 March 1987 (article 32 and its sub-paragraphs, together with articles 111-1, 133, 136, 142, 165, 208, 218, 219, 230, 232 and 234), in article 26 of the Universal Declaration of Human Rights of 10 December 1948, and in the law of 8 February 1962 that had instituted a Support Fund within the Department of National Education - the fund this law supersedes. The FNE became one of the most contested public-finance arrangements in Haiti, both because its resources came from levies outside the ordinary budget circuit and because the use of those resources was repeatedly questioned by the audit institutions. For anyone reading later reporting on education financing or on the free-schooling program, this is the enabling text.
