- Third version of the 2026 electoral decree, adopted 5 October and published 6 October 2026.
- 392 articles in twelve titles plus an annex.
- Covers presidential, legislative, local and indirect elections and the popular ratification of constitutional changes.
- At least 30 percent women among party candidates for the Chamber of Deputies.
- Article 390 provides for diaspora voting in the presidential election and the ratification, by order of the Council of Ministers.
This is the third version of the 2026 electoral decree, after the original of 2 June and the amendment of 2 July. It was given at the National Palace on 5 October 2026 and published the next day in a special issue of Le Moniteur. The preamble cites the decree of 2 June 2026 as amended on 2 July, states that Parliament is not functioning so the Executive legislates by decree, and records that the text follows a proposal from the Provisional Electoral Council (CEP) on the report of the ministers of Justice and of the Interior.
The decree runs to 392 articles in twelve titles and an annex. It covers the organization of the CEP and its departmental and communal bureaus (BED and BEC), the electoral register, candidate registration and the documents candidates must file, the campaign, the ballot for the popular ratification of constitutional changes, voting, tabulation, electoral disputes and offenses. It keeps a quota of at least 30 percent for women in CEP recruitment and requires parties to present at least 30 percent women candidates for the Chamber of Deputies. Article 390 lets Haitians living abroad who are registered voters vote in the presidential election and the ratification, in diaspora communities identified by the CEP, with the places and procedures to be set by an order of the Council of Ministers.
The CEP's press note 068 of 5 October 2026 tied this revision to an extension of online candidate registration to 31 October 2026 and to the postponement of the campaign period. The text here is an OCR reading of the scanned Moniteur.
